1. Terms and expressions used in these terms and conditions shall have the meanings set out in these terms and conditions as determined by the vendor on the basis of current legislation and a fair and honest approach to the customer.
    1. Online shop www.shopkikimono.com, we, the seller - KIKIMONO - Piotr Szuszkiewicz, with its registered office at Gajowa Street 42/ 10, in Wroclaw, post code 50-519 (Poland), Tax Identification Number 8942493857, e-mail address: contact@shopkikimono.com.
    2. Customer, Buyer, You - a natural or legal person, or an organizational unit without legal personality, making an order through the seller's website, using a user account for this purpose, or without such an account, carrying out a transaction.
  2. These terms and conditions are an integral part of each sales contract concluded and other legal relations related directly or indirectly to the business activity of the entrepreneur conducted by means of the online store available at www.shopkikimono.com.
  3. The subject of the sales contract may be products offered through the website, the price and specification of which is specified for each presented item.
  4. The goods offered for sale are brand new, free from legal and physical defects, legally acquired and offered by the seller
  5. The definition of the seller's liability for the goods is determined by the provisions of generally applicable law, including in relation to the liability for possible defects of goods art. 556 to 576 of the Civil Code, i.e. Journal of Laws of 2019, item 1145 as amended.
  6. All prices presented are gross prices including taxes due, but excluding customs duties related to their dispatch outside the European Economic Area
  7. Payment for the goods can be made by means of Paypal and Przelewy24 .
  8. Delivery on Polish territory costs 16 PLN and is carried out by DHL courier company. Delivery outside of Poland costs between 8 and 10 Euro. The exact cost is shown in the basket after selecting the country of delivery.

  10. We issue an electronic invoice for each transaction. All data indicated for the invoice comes from the customer and he bears full responsibility for their completeness and correctness, especially for indicating the postal address, e-mail address for delivery of proof of purchase.
  11. Orders are accepted through the website at all times with exceptions related to limited product availability or lack of product availability.
  12. The lead time is specified for each item available for sale.
  13. The buyer can set up a user account using the form available on the seller's website, which allows to track order history, edit personal data, download proof of purchase, wish list
  14. Regardless of whether the buyer makes a purchase by registering a user account or makes a purchase without such an account, he or she accepts each time before making a purchase the provisions of these regulations and which are an integral part of his or her privacy policy.
  15. The purchase process in the shop includes the following steps:
  1. Knowing and selecting the object of purchase
  2. Determination of quantity, type and other identifiable parameters of the product offered
  3. Determination of method, place of delivery and payment
  4. Indication of the data necessary for processing and shipping the order
  5. Confirm the order and finalize the transaction by using the button (hyperlinks) "Buy and pay".
  1. Complaints, objections and other issues related to both the functioning of the shop and the goods offered for sale can be sent to the e-mail address contact@shopkikimono.com. We commit to reply to your complaint within 14 days of receipt.
  2. Delivery is carried out by DHL courier company, the vendor protects and packages the goods before each shipment in order to properly secure them for the time of delivery. We recommend using the original cardboard box and packaging material when returning the goods to us.
  3. The shipping time, possible changes in this area are sent to the customer on an ongoing basis to the e-mail address indicated for contact or by phone to the telephone number provided by the customer.
  4. In the event that an order cannot be fulfilled due to even temporary impossibility of fulfilling the performance with the characteristics ordered by the customer, we may relieve ourselves of our obligation by fulfilling a substitute performance corresponding to the same quality and purpose of the product and for the same price or remuneration. At the same time, we inform the customer in writing of his right not to accept this service and to withdraw from the contract, with the return of the goods at our expense. In this case, you may withdraw from the contract and we shall bear the cost of returning the goods.   5. When the product is released to you as a customer, the ownership of the product, the rights and all risks associated with its possession and use, primarily the risk of loss or damage, will pass to you as a customer.
  6. Any objections related to the shipment should be reported immediately upon receipt by means of a damage report and, if possible, photographic documentation. These guidelines are a recommendation for action to ensure the most effective protection of buyer's rights.
  7. Gift cards:
  1. Available values of the gift card: 50€ / 100€ / 150€ / 200€
  2. The gift card can only be used in the online store www.shopkikimono.com
  3. The withdrawal from the contract of goods purchased with the card will result in the return of the card of an appropriate value for the transaction. The purchase made by means of a gift card and other forms of payment shall result in the return of the purchase amount appropriate to the transaction.
  4. A purchase below the value of the card does not entitle you to a cash refund. Unused amount can be used for further purchases.
  5. Cards in electronic form are sent to the indicated e-mail address.
  6. The gift card is valid for 6 months from the date of purchase, after that time it is not redeemable.
  7. The card is generated individually for each customer, so its return is excluded.
  8. Purchase of the card means acceptance of the shop regulations.
  • Withdrawal from the contract:
  1. Pursuant to the Consumer Rights Act, as a consumer, you can withdraw from a distance contract. You have 14 days from the date of delivery. You do not have to give a reason. You can send a notice of withdrawal from the contract:

  4. you can exercise your right of withdrawal by using the form or by formulating it in your own words
  5. The running of the period referred to above shall commence from the day following the day of release of the Goods to the Consumer or a person designated by him other than the courier.
  6. You, as a consumer, do not have a right of withdrawal from an off-premises or distance contract:
    I.
    where the object of the benefit is a customized item, manufactured to your specifications or to meet your individual needs;
    II.
    in which the object of the service is an item that we deliver in sealed packaging and which cannot be returned for health or hygienic reasons if the packaging has been opened after delivery.
  7. You are responsible for reducing the value of a thing that results from using it in a way that goes beyond what is necessary to determine its character, characteristics and functioning.
  8. You send the product back immediately, up to 14 days after submitting the withdrawal statement.
  9. If you withdraw from the contract without giving any reason within 14 days from the date on which the item was handed over, you will bear the cost of returning the product directly to us
  10. If, when placing an order, you choose a different delivery method than the cheapest, usual one offered in our shop - we will reimburse you for only the cheapest delivery method
  11. The rights and obligations specified in the section entitled to withdraw from the contract apply to you only if you have the status of a consumer and you are purchasing goods from the webshop through a distance contract.
